Membership Acceptance of Terms

1 Membership Agreement

By creating an account and making payment, you enter into a binding service agreement with IronForge Fitness LLC ("Company", "we", "us", or "our"). Membership is non-transferable and intended for the named individual only. You must be at least 18 years of age, or accompanied by a legal guardian if between 16-17 years of age, to utilize our facilities.

All memberships are subject to availability and may be suspended or terminated at our discretion for violations of this agreement, facility rules, or non-payment.

2 Code of Conduct & Facility Rules

Members are expected to maintain a respectful, safe, and professional environment. The following conduct is strictly prohibited:

• Verbal abuse, harassment, intimidation, or discriminatory behavior toward staff or other members
• Misuse of equipment, loitering, or unauthorized recording of members/staff
• Consumption of alcohol, illegal substances, or bringing outside food/drinks into training zones
• Bringing unauthorized guests, pets, or minors under 16 into restricted areas

Violations may result in immediate suspension, permanent termination, and forfeiture of remaining membership fees.

3 Liability & Waiver of Claims

Physical Activity Warning: Participation in fitness activities carries inherent risks of injury, including but not limited to strain, sprain, cardiac events, and musculoskeletal damage. You acknowledge these risks and voluntarily assume full responsibility for your participation.

You hereby release, waive, discharge, and covenant not to sue IronForge Fitness, its owners, employees, contractors, agents, and affiliates from any and all liability, claims, demands, actions, and causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by you while using the facilities, equipment, or participating in programs offered by the Company.

4 Health & Safety Acknowledgment

You represent that you are in good physical condition and have no medical conditions that would prevent you from safely participating in exercise activities. You agree to consult a physician before beginning any new fitness or nutrition program, especially if you have a history of cardiovascular, metabolic, orthopedic, or respiratory conditions.

IronForge Fitness is not a medical facility and does not provide medical advice. Our trainers and staff are not licensed physicians. Emergency medical services may be contacted if necessary, but you remain responsible for associated costs and outcomes.

5 Payment, Billing & Cancellation

Memberships are billed monthly, quarterly, or annually according to the selected plan. Payment authorizations are processed on the anniversary date of enrollment. Late payments may incur a $15 processing fee.

• Cancellation: Cancel anytime via your member portal or by written notice 7 days before the next billing cycle.
• Freeze Policy: Members may freeze their account for up to 90 days per year (medical, military, or relocation with proof required).
• Refunds: Pro-rated refunds are only available within the first 14 days of enrollment, subject to a $30 administrative fee.

6 Privacy & Data Usage

We collect and process personal data strictly in accordance with our Privacy Policy. This includes contact information, payment details, health/fitness assessments, and usage analytics. Your data will never be sold to third parties. It may be shared with contracted service providers necessary for billing, facility management, or legal compliance.

You retain the right to access, correct, or request deletion of your personal information at any time, subject to applicable data retention laws.

7 Amendments & Governing Law

IronForge Fitness reserves the right to modify these terms at any time. Continued use of our facilities following posted updates constitutes acceptance of revised terms. Material changes will be communicated via email or member portal notification.

This agreement shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in NYC, unless otherwise required by law.
