IRONFORGE FITNESS LIABILITY WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNIFICATION AGREEMENT
1. ASSUMPTION OF RISK
I, the undersigned, understand and acknowledge that participation in physical fitness activities, including but not limited to weight training, cardiovascular exercise, group fitness classes, personal training, use of equipment, and facility usage at IronForge Fitness (the \"Company\"), involves inherent risks of injury, illness, disability, or death. I voluntarily assume all such risks, both known and unknown, and agree to participate entirely at my own risk.
2. RELEASE & WAIVER OF LIABILITY
In consideration of being permitted to enter and use the facilities and services of IronForge Fitness, I hereby release, waive, discharge, and covenant not to sue IronForge Fitness, its owners, operators, managers, employees, agents, successors, and affiliates (collectively, the \"Released Parties\") from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, while entering, exiting, or within the premises, or while participating in any activities, whether caused by the negligence of the Released Parties or otherwise.
3. INDEMNIFICATION
I agree to indemnify and hold harmless the Released Parties from any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of or related to my use of the facilities or participation in activities, including any breach of this Agreement.
4. MEDICAL CONSENT
In the event of an emergency requiring medical treatment during my participation in activities at IronForge Fitness, I authorize the Company and its staff to arrange for emergency medical treatment and/or transportation to a medical facility. I agree that the Released Parties shall not be liable for any costs associated with such treatment or transportation, and I accept full financial responsibility.
5. PHOTOGRAPHY & MEDIA RELEASE
I grant IronForge Fitness the irrevocable permission to photograph, film, or record my likeness and voice during classes, training sessions, or events, and to use such media for promotional, marketing, educational, or archival purposes without compensation.
6. MINOR PARTICIPATION (If applicable)
If I am signing on behalf of a minor under 18 years of age, I represent that I am the parent or legal guardian and have full legal authority to enter into this Agreement. All releases and waivers apply to the minor as if executed by the minor.
7. GOVERNING LAW & SEVERABILITY
This Agreement shall be governed by and construed in accordance with the laws of the State in which the IronForge Fitness location is situated. If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
BY PROVIDING MY SIGNATURE BELOW, I ACKNOWLEDGE THAT I HAVE READ THIS AGREEMENT IN ITS ENTIRETY, FULLY UNDERSTAND ITS TERMS, AND FREELY AGREE TO BE BOUND BY THEM. I HAVE HAD THE OPPORTUNITY TO CONSULT WITH LEGAL COUNSEL PRIOR TO SIGNING.
