Membership Agreement
Membership Type & Term
IronForge Fitness ("Company", "Gym", or "IronForge") offers various membership tiers, including Starter, Pro Athlete, and Elite. Each membership grants access to designated facilities, classes, and services as specified in your selected plan.
Memberships are activated on the date of successful payment verification and remain active until explicitly cancelled in accordance with Section 03. Initial terms may be month-to-month or fixed-term (e.g., 6, 12 months) as selected at enrollment. Fixed-term memberships carry an early termination fee equivalent to 10% of the remaining contract value.
Fees & Payment Authorization
By enrolling, you authorize IronForge to automatically charge the payment method on file on your designated billing date. Standard monthly fees, taxes, and applicable facility fees will be processed accordingly.
- Late Payments: A $15 late fee applies if payment is not received within 5 days of the billing date.
- Returned Payments: A $25 NSF fee applies to declined cards or insufficient funds.
- Plan Upgrades/Downgrades: Prorated adjustments take effect on the next billing cycle. Downgrades require 10 days' notice before the renewal date.
Cancellation & Refunds
Members may cancel their membership at any time via the member portal, in writing via email to memberships@ironforge.fit, or by visiting the front desk in person. Cancellation takes effect at the end of the current billing cycle.
Refunds are not provided for partial months, unused class credits, or mid-cycle cancellations unless explicitly stated in a promotional offer. Medical suspensions require a physician's note and may pause billing for up to 90 days, renewable once.
Facility Use & Code of Conduct
Members agree to use IronForge facilities responsibly and respectfully. This includes:
- Wearing appropriate footwear and gym attire at all times
- Racking weights, wiping down equipment, and returning items after use
- Refraining from abusive language, harassment, or discriminatory behavior
- Not using personal electronics that interfere with others' workouts
- Guests must be accompanied by a member in good standing and follow all facility rules
Violations may result in a written warning, temporary suspension, or permanent termination at IronForge's discretion.
Health Disclosure & Assumption of Risk
You represent that you are in good health and physically capable of participating in fitness activities. IronForge recommends consulting a physician before beginning any exercise program, especially if you have pre-existing conditions, injuries, or pregnancy-related considerations.
By accepting this agreement, you voluntarily assume all risks associated with physical activity, including but not limited to strains, sprains, cardiovascular events, and equipment-related injuries, to the fullest extent permitted by law.
Limitation of Liability & Waiver
To the maximum extent permitted by applicable law, IronForge Fitness, its owners, employees, contractors, and affiliates shall not be liable for any personal injury, property damage, data loss, or incidental/consequential damages arising from your use of the facilities, equipment, or services.
This waiver survives termination of membership and applies to any claims arising from activities conducted at IronForge premises or during sanctioned events, regardless of negligence.
Privacy & Media Consent
IronForge collects membership data solely for billing, access control, and service improvement. We comply with applicable data protection regulations and will not sell your personal information to third parties.
By entering IronForge facilities, you consent to being photographed or recorded for internal security, operational reviews, and marketing materials. Opt-out requests for promotional use may be submitted to privacy@ironforge.fit within 30 days of enrollment.
Suspension & Termination Rights
IronForge reserves the right to immediately suspend or terminate a membership for:
- Repeated code of conduct violations
- Unpaid balances exceeding 30 days
- Fraudulent enrollment or misrepresentation
- Illegal activities or threats to staff/member safety
Termination for cause is non-refundable. Members may appeal suspensions by contacting management within 7 days.
Dispute Resolution & Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles.
Any disputes arising from this Agreement shall first be addressed through good-faith negotiation. If unresolved within 30 days, both parties agree to binding arbitration in New York County under AAA commercial rules. Court action is waived except for injunctive relief or intellectual property claims.
Entire Agreement & Amendments
This document constitutes the entire agreement between you and IronForge Fitness regarding your membership. All prior oral or written agreements are superseded. IronForge may modify this Agreement with 14 days' written notice. Continued use of services after notice constitutes acceptance of changes.
