1. Assumption of Risk
I, the undersigned participant ("Participant"), acknowledge that participation in physical fitness activities, including but not limited to strength training, cardio, group fitness classes, boxing, yoga, use of gym equipment, and personal training sessions at IronForge Fitness ("Facility"), involves inherent risks of physical injury, including but not limited to sprains, strains, fractures, concussions, cardiovascular events, and in rare cases, permanent injury or death.
I voluntarily assume all known and unknown risks associated with my participation in these activities, regardless of whether such risks are caused by negligence of IronForge Fitness, its owners, managers, employees, contractors, or other participants.
2. Release & Waiver of Liability
In consideration of being permitted to participate in activities at the Facility, I hereby knowingly and voluntarily release, waive, discharge, and covenant not to sue IronForge Fitness, its affiliates, owners, directors, officers, employees, independent contractors, and agents (collectively, the "Released Parties") from any and all liability, claims, demands, causes of action, or damages arising out of or related to any loss, injury, or damage that may be sustained by me while participating in or preparing to participate in any activities at the Facility.
This release extends to claims based on negligence, provided that such release shall not apply to gross negligence or willful misconduct where prohibited by applicable law.
3. Medical Clearance & Health Disclosure
I certify that I am in good physical condition and medically cleared to participate in strenuous physical activity. I have no known physical, mental, or psychological condition that would make participation in fitness activities dangerous to myself or others.
I understand that IronForge Fitness is not responsible for evaluating my health status. I agree to seek appropriate medical advice before beginning any new exercise program and to discontinue participation immediately if I experience pain, dizziness, shortness of breath, chest discomfort, or any other concerning symptoms.
4. Emergency Medical Treatment Authorization
In the event of a medical emergency during my participation in Facility activities, I hereby authorize IronForge Fitness and its personnel to arrange for and consent to emergency medical treatment, including transportation to the nearest appropriate medical facility, on my behalf. I accept full financial responsibility for all medical expenses incurred as a result of any injury or illness sustained during my participation.
5. Indemnification
I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, expenses (including reasonable attorney’s fees), and causes of action arising out of or related to my participation at the Facility, including but not limited to claims resulting from my failure to follow instructions, misuse of equipment, or violation of Facility rules.
6. Media & Photography Consent
I understand and acknowledge that IronForge Fitness may photograph, film, or record participants during classes, events, or Facility operations for promotional, educational, or archival purposes. I hereby grant IronForge Fitness a non-exclusive, perpetual, royalty-free license to use, reproduce, distribute, and display such media in any format, including social media, websites, and advertising materials, without compensation.
7. Governing Law & Severability
This Agreement shall be governed by and construed in accordance with the laws of the state in which the Facility is located, without regard to conflict of law principles. If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect.
I acknowledge that I have read this Agreement in its entirety, understand its terms, and sign it voluntarily. I understand that this Agreement is intended to be as broad and inclusive as permitted by law.
