By accessing, browsing, or purchasing from LuxeMart, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not use our Services. LuxeMart reserves the right to update or modify these Terms at any time. Continued use of the Services following any changes constitutes your acceptance of the new Terms.

3 User Accounts & Registration

To make purchases, save preferences, or track orders, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for safeguarding your account credentials and for all activities that occur under your account. Notify us immediately at support@luxemart.com if you suspect any unauthorized use. LuxeMart reserves the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4 Purchases, Pricing & Payment

All product prices are listed in USD and are subject to change without prior notice. Prices displayed on our website are accurate to the best of our ability, but in the event of an obvious pricing error, LuxeMart reserves the right to cancel or refuse orders placed at the incorrect price. All sales are final unless otherwise stated in our Return Policy. You must provide valid payment information. By submitting an order, you authorize us to charge your selected payment method. We do not store full payment card details; all transactions are processed through secure, PCI-compliant third-party payment gateways.

5 Shipping & Delivery

Shipping costs, delivery estimates, and carrier options will be displayed at checkout. LuxeMart is not responsible for delays caused by carriers, customs clearance, or incorrect shipping addresses provided by the customer. Once an order is shipped, you will receive a tracking number via email. Risk of loss and title for purchased items pass to you upon delivery to the carrier.

6 Returns, Refunds & Cancellations

Orders may be cancelled within 2 hours of placement if they have not yet been processed for shipment. After this window, cancellations are subject to our Return Policy. Eligible items may be returned within 30 days of delivery in original, unused condition with proof of purchase. Refunds will be issued to the original payment method within 5-10 business days after the return is received and inspected. Certain items (e.g., personalized goods, digital downloads, perishables) are non-refundable unless defective.

7 Intellectual Property

All Content, trademarks, logos, and proprietary materials on LuxeMart are the exclusive property of LuxeMart LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any Content without prior written consent. Limited use is permitted for personal, non-commercial browsing. User-generated content submitted to LuxeMart grants us a non-exclusive, royalty-free, worldwide license to display, distribute, and modify such content solely for the purpose of operating the Services.

8 User Conduct & Prohibited Activities

You agree not to use the Services for any unlawful purpose or in any way that could damage, disable, or impair the platform. Prohibited activities include but are not limited to:

  • Using automated scraping, bots, or unauthorized data collection tools
  • Attempting to gain unauthorized access to systems or user accounts
  • Posting harmful, offensive, or infringing content
  • Reselling products without authorization or engaging in price manipulation
  • Interfering with the security or integrity of the Services

Violation of these provisions may result in immediate termination of access, account suspension, and legal action.

9 Disclaimers & Limitation of Liability

The Services and Products are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. LuxeMart does not warrant that the Services will be uninterrupted, secure, or error-free. To the maximum extent permitted by applicable law, LuxeMart shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use or inability to use the Services or purchased Products.

10 Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Wilmington, Delaware. Judgment on the arbitration award may be entered in any court having jurisdiction. You waive any right to participate in a class-action lawsuit or consolidated proceeding.

11 Changes to Terms

LuxeMart reserves the right to modify, update, or replace these Terms at any time. Material changes will be communicated via email or a prominent notice on our website. Your continued use of the Services after such changes constitutes acceptance. It is your responsibility to review these Terms periodically.
