01 Acceptance of Terms
By accessing, browsing, or utilizing the 1990 Web Archive platform ("Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and Conditions. If you do not agree with any part of these terms, you must discontinue use of the Service immediately.
These terms apply to all users, researchers, developers, API consumers, and casual visitors accessing archived content through our web interface, mobile applications, or programmatic endpoints.
02 Definitions & Scope
- Archive: The collection of historically preserved web pages, metadata, images, and multimedia captured between 1990 and present.
- Content: Any text, image, code, audio, or video stored within the Archive, regardless of original authorship.
- User: Any individual or entity interacting with the Service.
- Service: The 1990 Web Archive website, API, rendering engine, and associated tools.
03 Archive Access & Usage
The Archive is provided for educational, historical, research, and personal use. You are granted a non-exclusive, non-transferable, revocable license to view, download, and analyze archived content subject to the following restrictions:
- Automated scraping must comply with our robots.txt and rate limits.
- Commercial redistribution of bulk archived datasets requires a formal licensing agreement.
- Modification, alteration, or misrepresentation of original archived content is strictly prohibited.
04 Intellectual Property
All original archival infrastructure, rendering engines, search algorithms, and platform-specific interfaces are the intellectual property of 1990 Web Archive and protected under applicable copyright and trademark laws.
Archived third-party content retains its original copyright status. We do not claim ownership over historically preserved webpages but facilitate their preservation and access. Users are responsible for ensuring their use of archived content complies with fair use doctrine or original copyright holder permissions.
05 User Responsibilities
Users agree not to:
- Use the Service for unlawful purposes, including but not limited to harassment, fraud, or distribution of malicious software.
- Attempt to circumvent access controls, encryption, or rate-limiting mechanisms.
- Impersonate the Archive, its staff, or affiliated institutions.
- Interfere with the integrity or performance of the Service infrastructure.
06 Data Privacy
We collect minimal operational data necessary to maintain Service functionality, including IP addresses, API usage logs, and crash reports. This data is processed in accordance with our Privacy Policy and applicable data protection regulations (GDPR, CCPA).
We do not sell user data to third parties. Historical archive metadata may be shared with accredited academic institutions for preservation research purposes.
07 Limitation of Liability
The Archive is provided "as is" without warranties of any kind, either express or implied. While we strive for historical accuracy, we do not guarantee that archived content remains complete, unaltered, or free from technical rendering artifacts.
1990 Web Archive shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the Service, reliance on archived content, or interruption of access.
08 Modifications
We reserve the right to update, modify, or replace these Terms at any time. Material changes will be notified via email or prominent announcement on the Service. Continued use following the posting of revised terms constitutes acceptance of those changes.
09 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state or federal courts located in Wilmington, Delaware.
