Intellectual Property Policy

Effective Date: January 1, 2025 | Version 2.1

1. Scope & Purpose

In Therapy ("Company," "we," "our") is committed to respecting the intellectual property rights of others while protecting our own proprietary clinical frameworks, digital resources, brand assets, and therapeutic methodologies. This Intellectual Property Policy outlines the rights, responsibilities, and procedures governing the use, protection, and enforcement of intellectual property across our platforms, services, and publications.

This policy applies to all clients, users, contractors, partners, and third parties interacting with In Therapy's digital platforms, telehealth services, clinical materials, and branded resources.

3. Proprietary Clinical Materials

In Therapy develops and maintains proprietary therapeutic protocols, assessment tools, digital intervention modules, and clinician training frameworks. These materials are considered confidential business assets and are protected under trade secret and copyright law.

Authorized clinicians and staff may access these materials through secure, licensed platforms for the purpose of delivering care and maintaining clinical standards. Unauthorized extraction, reverse engineering, or dissemination of proprietary clinical algorithms, session structures, or internal training content is strictly prohibited and may result in termination of access and legal action.

4. Client-Generated Content

Clients retain full ownership of personal notes, journal entries, feedback, and creative content shared during or outside of therapy sessions. By using In Therapy's platforms, clients grant us a limited, non-exclusive license to store, process, and securely transmit such content solely for therapeutic, administrative, and continuity-of-care purposes.

We do not claim ownership of client-generated content. All personal data and creative submissions are handled in strict compliance with HIPAA, GDPR (where applicable), and our Privacy Policy. Clients may request deletion or export of their personal content at any time through secure channels.

5. Third-Party Materials

Certain assessment tools, research citations, partner content, or integrations used within our clinical workflows may be owned by third parties. In Therapy licenses or references these materials under appropriate academic, commercial, or institutional agreements.

All third-party content is used in accordance with granted licenses, fair use provisions, or explicit permissions. Where required, proper attribution is provided. Third-party rights remain unaffected by our policy, and disputes regarding third-party materials should be directed to the respective rights holders or through the reporting process below.

6. Reporting Infringement

If you believe that your intellectual property rights have been infringed upon through content hosted or distributed by In Therapy, please submit a formal notification to our IP Compliance Team. Your notice must include:

  • A physical or electronic signature of the rights holder or authorized agent
  • Identification of the copyrighted or trademarked work claimed to be infringed
  • A description of the infringing material and its location on our platforms
  • Your contact information (email, phone, mailing address)
  • A statement of good faith that the use is not authorized by the rights holder, its agent, or the law
  • A statement made under penalty of perjury that the information provided is accurate and that you are authorized to act on behalf of the rights holder

False claims of intellectual property infringement may result in legal liability under applicable laws. We reserve the right to remove content pending investigation and to cooperate with law enforcement if fraud is suspected.

7. Enforcement & Remedies

In Therapy reserves the right to enforce its intellectual property rights through all available legal remedies, including but not limited to injunctive relief, monetary damages, and account termination. We may issue takedown notices to hosting providers, domain registrars, or digital platforms hosting infringing copies of our materials.

Users found to be repeatedly infringing upon our IP rights or submitting fraudulent DMCA counter-notices may be permanently restricted from accessing In Therapy's services and reported to relevant authorities where applicable.
