Acceptance of Terms
By accessing, browsing, or using the In Therapy website, mobile application, or any of the therapy services offered (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to all of these Terms, you may not use our Services.
These Terms constitute a legally binding agreement between you and In Therapy, LLC ("Company," "we," "us," or "our"). You represent that you have read, understood, and agree to be bound by these Terms.
⚠️ Important: If you are using our Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
Services Overview
In Therapy provides an online platform that connects users with licensed mental health professionals for virtual and in-person therapy sessions. Our Services include, but are not limited to:
- Individual Therapy: One-on-one therapy sessions with licensed counselors, psychologists, or psychiatrists.
- Couples & Family Counseling: Mediated therapy sessions for relationships and family dynamics.
- Teen Therapy: Specialized mental health support for adolescents aged 13–17.
- Self-Assessment Tools: Optional mental health questionnaires and wellness tracking features.
- Resource Library: Access to curated articles, guides, and psychoeducational materials.
- Live Chat Support: Messaging with care coordinators for scheduling and administrative assistance.
Our Services are designed to support mental wellness and are not a substitute for emergency medical care, psychiatric hospitalization, or crisis intervention services.
Eligibility & Account Requirements
3.1 Minimum Age
You must be at least 18 years of age to create an account and use our Services independently. Users between the ages of 13 and 17 may use our Services only with the involvement and consent of a parent or legal guardian who agrees to these Terms on their behalf.
3.2 Account Registration
To access certain Services, you must create an account by providing accurate, current, and complete information. You agree to:
- Maintain and update your account information to keep it accurate and current.
- Maintain the security of your account password and credentials.
- Take responsibility for all activities that occur under your account.
- Notify us immediately of any unauthorized use of your account at support@intherapy.com.
3.3 Accuracy of Information
You agree to provide truthful and accurate personal information, medical history, and mental health history. Providing false, misleading, or incomplete information may result in immediate termination of your account and services.
Professional Disclaimers
4.1 No Medical Advice
The Services provided by In Therapy are for educational and informational purposes only and do not constitute medical advice, diagnosis, or treatment. Therapy conversations through our platform should not replace professional medical care.
🚨 Crisis Emergency: If you are experiencing a mental health emergency, please call 988 (Suicide & Crisis Lifeline) or 911 immediately, or go to your nearest emergency room. Our platform is not equipped to handle emergencies.
4.2 Therapist Independence
Therapists connected through our platform are independent licensed professionals. In Therapy acts solely as a facilitator platform and does not employ, supervise, or control the professional judgment of individual therapists. The therapist-client relationship is established directly between you and the assigned professional.
4.3 Scope of Practice
Each therapist provides services within the scope of their professional licensure and competence. In Therapy does not guarantee specific therapeutic outcomes, as results vary based on individual circumstances, commitment to the process, and other factors beyond our control.
Confidentiality & Privacy
5.1 HIPAA Compliance
In Therapy is committed to protecting your health information in accordance with the Health Insurance Portability and Accountability Act (HIPAA), as well as applicable state and federal privacy laws. All protected health information (PHI) is encrypted and stored securely.
5.2 Confidentiality of Sessions
Your therapy sessions are confidential and protected by law. Our therapists are bound by professional ethical guidelines and legal requirements to maintain confidentiality. However, therapists are mandated reporters and may be required to disclose information if they believe you are a danger to yourself or others, or if abuse of a child or vulnerable adult is suspected.
5.3 Data Collection & Use
We collect and process your data in accordance with our Privacy Policy, including:
- Personal Information: Name, email, phone number, date of birth.
- Health Information: Mental health history, treatment notes, session records (encrypted).
- Payment Information: Billing details processed through secure third-party processors.
- Usage Data: Website analytics, session duration, platform usage patterns.
We do not sell your personal or health information to third parties. Data is shared only with service providers necessary for platform operation under strict data processing agreements.
Code of Conduct
By using our Services, you agree to conduct yourself respectfully and responsibly. The following behaviors are strictly prohibited:
- Harassment or Abuse: Threatening, harassing, or abusing therapists, staff, or other users in any form.
- Misrepresentation: Providing false identity information or impersonating another person.
- Illegal Activities: Using our platform to facilitate any illegal activity or content.
- Non-Consensual Recording: Recording therapy sessions without the explicit written consent of all parties.
- Circumvention: Attempting to bypass security measures, access restricted areas, or exploit platform vulnerabilities.
- Medical Misinformation: Deliberately providing false medical information that could compromise your care.
- Substance Influence: Participating in therapy sessions while under the influence of substances to the point of impairing the therapeutic process.
Violations of this Code of Conduct may result in immediate account suspension, termination of services, and referral to law enforcement if applicable.
Intellectual Property
7.1 Platform Content
All content, materials, and intellectual property available through our Services — including text, graphics, logos, icons, images, software, designs, and the "In Therapy" name and logo — are owned by In Therapy or its licensors and are protected by intellectual property laws.
7.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to access and use our Services for personal, non-commercial purposes. This license does not permit you to:
- Reproduce, distribute, or modify any platform content.
- Use any data mining, scraping, or automated collection methods.
- Create derivative works from our content or platform.
- Remove any proprietary notices or labels from the platform.
7.3 Therapist Content
Content created by individual therapists (including treatment plans, worksheets, and session materials) remains the intellectual property of the respective therapist. You may use such materials solely for your personal therapeutic benefit and may not redistribute or reproduce them without the therapist's written consent.
Payment & Billing
8.1 Fees
Sessions and services are billed according to the pricing displayed on our platform at the time of booking. All fees are quoted in USD unless otherwise stated. In Therapy reserves the right to adjust pricing with 30 days' advance notice.
8.2 Payment Methods
We accept the following payment methods:
- Credit and debit cards (Visa, Mastercard, American Express, Discover)
- Health Savings Accounts (HSA) and Flexible Spending Accounts (FSA)
- Direct insurance billing (where applicable)
- Sliding-scale payments for eligible users
8.3 Insurance
In Therapy works with select insurance providers. Coverage varies by plan and provider. We will verify your benefits before your first session, but ultimate coverage and reimbursement are determined by your insurance carrier, not by In Therapy.
8.4 Billing Cycle
Sessions are billed immediately upon booking. Subscriptions (if offered) are billed at the start of each billing period. All charges will appear on your statement under the descriptor "In Therapy" or "IN THERAPY LLC".
Cancellation & Refund Policy
9.1 Session Cancellation by Client
You may cancel or reschedule a scheduled session at least 24 hours in advance at no charge. Cancellations made within 24 hours of the scheduled session time will be charged 50% of the session fee. No-shows will be charged 100% of the session fee.
9.2 Therapist Cancellation
If your therapist cancels a session, you will be offered an alternative time at no charge, or a full refund will be issued to your original payment method.
9.3 Refund Eligibility
Refunds may be granted at In Therapy's discretion under the following circumstances:
- Technical failures on the platform that prevent session delivery.
- Serious breach of therapeutic boundaries by the assigned therapist.
- Inability to match with a therapist within 7 days of signup (full subscription refund).
For refund requests, contact billing@intherapy.com with your account details. Requests must be submitted within 30 days of the charge.
Termination
10.1 By You
You may terminate your account and discontinue use of our Services at any time by contacting support@intherapy.com. Upon termination, your right to use the Services will cease immediately. Any outstanding fees remain your responsibility.
10.2 By In Therapy
In Therapy reserves the right to suspend or terminate your access to the Services at any time, with or without cause, and with or without notice, including but not limited to:
- Violation of these Terms or our Code of Conduct.
- Failure to make required payments.
- Threats to the safety of therapists, staff, or other users.
- Abuse of our platform or fraudulent activity.
10.3 Data Retention Post-Termination
Upon account termination, your session notes and health records will be securely retained for a period of 7 years in compliance with healthcare record-keeping regulations. You may request a copy of your records prior to or following termination.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN THERAPY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, THERAPISTS, AND LICENSORS SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.
- Any damages arising from your use or inability to use the Services.
- Any unauthorized access to or use of our servers and/or any personal information stored therein.
- Any conduct or content of any therapist or third party on the platform.
- Any errors or omissions in any content or information provided through the Services.
- Disconnection from the internet or technical failures during sessions.
IN NO EVENT SHALL IN THERAPY'S TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT PAID BY YOU TO IN THERAPY IN THE SIX (6) MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages. Accordingly, some of the above limitations may not apply to you.
Dispute Resolution
12.1 Informal Resolution
In the event of any dispute, controversy, or claim arising out of or relating to these Terms (a "Dispute"), you agree to first attempt to resolve the Dispute informally by contacting legal@intherapy.com with a written description of the nature and basis of your claim.
12.2 Arbitration
If the Dispute is not resolved informally within 30 days, both parties agree to resolve any remaining Disputes through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted in San Francisco, California, by a single arbitrator.
12.3 Class Action Waiver
You and In Therapy agree that any Disputes shall be resolved only on an individual basis and not as part of any class or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.
12.4 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods shall not apply.
12.5 Exceptions
Notwithstanding the above, either party may bring a claim in small claims court if the claim qualifies under applicable small claims court rules. Additionally, either party may seek injunctive relief in court to prevent irreparable harm.
Changes to Terms
In Therapy reserves the right to modify, amend, or update these Terms at any time. Changes will be effective immediately upon posting to the platform. We will notify users of material changes via email at least 30 days prior to the effective date of such changes.
Continued use of the Services after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must cease use of the Services and terminate your account.
We encourage you to review this page periodically for the latest information on our Terms of Service. Your continued use of our Services after any modifications means you accept those modifications.
