📋 Terms of Service

Effective Date: July 1, 2025

Welcome to RaiseIt. These Terms of Service ("Terms") govern your use of the RaiseIt platform, website, and services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part, you may not access the Service.

1.1 Definitions

  • "Platform" means the RaiseIt website, mobile applications, and related infrastructure.
  • "Creator" means a user who launches a crowdfunding campaign on the Platform.
  • "Backer" means a user who contributes financially to a campaign.
  • "Campaign" means a project page created by a Creator to solicit funds from Backers.
  • "Funds" means monetary contributions made by Backers to support a Campaign.

1.2 Eligibility

By using RaiseIt, you represent and warrant that you are at least 18 years of age (or the age of majority in your jurisdiction), have the legal capacity to enter into binding agreements, and are not barred from using the Service under applicable law.

1.3 Account Registration

To use certain features, you must create an account. You agree to provide accurate, current, and complete information, and to update such information to keep it accurate. You are responsible for maintaining the security of your account credentials and for all activity under your account.

Important: RaiseIt reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or otherwise compromise the integrity of the platform.

1.4 Creator Responsibilities

As a Creator, you are solely responsible for the content of your Campaign and fulfilling all promises made to Backers. This includes, but is not limited to:

  1. Delivering promised rewards within the timeframe stated in your Campaign
  2. Providing honest and accurate project descriptions, timelines, and budgets
  3. Communicating regularly with Backers about campaign progress and any delays
  4. Ensuring your project complies with all applicable laws and regulations
  5. Not collecting Funds for any purpose other than the Campaign for which they were pledged

1.5 Backer Rights and Responsibilities

When you back a Campaign, you are making a contribution to support a project — not purchasing a product or service. Crowdfunding carries inherent risk. You acknowledge and accept that:

  • Projects may not be completed as described or may never be completed
  • Rewards may differ from what was described, or may not be delivered at all
  • You are solely responsible for evaluating the merits and risks of a Campaign before contributing
  • RaiseIt does not guarantee project completion or reward fulfillment

1.6 Prohibited Conduct

You agree not to engage in any of the following activities:

  • Creating fraudulent, misleading, or deceptive Campaigns
  • Using the Platform for money laundering or illegal activities
  • Soliciting Funds for personal financial obligations (e.g., debt repayment, medical bills)
  • Violating any intellectual property rights of third parties
  • Engaging in spam, harassment, or abusive behavior
  • Attempting to circumvent RaiseIt's payment processing or fee structure
  • Creating multiple accounts to manipulate campaign metrics

1.7 Intellectual Property

You retain ownership of the content you create and submit to the Platform. By posting content, you grant RaiseIt a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content for purposes of operating and promoting the Service. RaiseIt's trademarks, logos, and proprietary technology remain the exclusive property of RaiseIt Inc.

1.8 Limitation of Liability

Disclaimer: RaiseIt acts solely as an intermediary platform connecting Creators and Backers. We are not a party to any transaction between them. To the maximum extent permitted by law, RaiseIt shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Service or interactions between users.

1.9 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes shall be resolved in accordance with our Dispute Resolution policy below.

1.10 Changes to Terms

We may update these Terms from time to time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

🔒 Privacy Policy

RaiseIt Inc. ("RaiseIt," "we," "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our Platform.

2.1 Information We Collect

We collect information in the following categories:

Personal Information

  • Account Information: Name, email address, phone number, date of birth, and profile photo
  • Payment Information: Credit card numbers, bank account details, and billing addresses (processed securely via our payment partners)
  • Campaign Information: Project descriptions, uploaded media, reward details, and fulfillment information
  • Communication Records: Messages, comments, and feedback exchanged through the Platform

Automatically Collected Information

  • Usage Data: Pages visited, features used, time spent, and navigation patterns
  • Device Information: IP address, browser type, operating system, and device identifiers
  • Location Data: Approximate geographic location based on IP address
  • Cookies & Tracking: Information collected through cookies and similar technologies (see Cookie Policy)

2.2 How We Use Your Information

We use collected information for the following purposes:

  • Processing and facilitating crowdfunding transactions
  • Verifying identity and preventing fraud
  • Communicating with you about campaigns, updates, and platform features
  • Improving and personalizing the user experience
  • Complying with legal obligations and regulatory requirements
  • Analyzing platform usage to enhance service quality
  • Protecting the rights, property, and safety of RaiseIt and its users

2.3 Sharing Your Information

We may share your information in the following circumstances:

  • With Campaign Creators: When you back a project, your name, email, and pledge amount are shared with the Creator for fulfillment purposes
  • With Payment Processors: Necessary payment information is shared with our payment partners (Stripe, PayPal) to process transactions
  • Service Providers: With trusted third-party providers who assist in operating our platform (hosting, analytics, customer support)
  • Legal Requirements: When required by law, subpoena, or to protect legal rights
  • Business Transfers: In connection with a merger, acquisition, or sale of assets

We do NOT sell your personal information to third-party data brokers or advertisers. Your trust is fundamental to our platform.

2.4 Data Retention

We retain your personal information for as long as your account is active or as needed to provide Services. We may also retain information to resolve disputes, enforce agreements, and comply with legal obligations. Upon account deletion, personal data will be removed within 30 days, except where legal retention requirements apply.

2.5 Your Rights (GDPR / CCPA)

2.6 Data Security

We implement industry-standard security measures including encryption (TLS 1.3), tokenization of payment data, regular security audits, and access controls. While no system is 100% secure, we continuously work to protect your information.

2.7 Children's Privacy

RaiseIt is not intended for children under 13. We do not knowingly collect personal information from children under 13. If we discover such information, we will delete it immediately.

RaiseIt uses cookies and similar tracking technologies to enhance your experience, analyze usage, and deliver personalized content. This policy explains what cookies are, how we use them, and your choices.

3.1 What Are Cookies?

Cookies are small text files stored on your device when you visit a website. They help the site remember your preferences, authenticate your session, and collect analytics data.

3.2 Types of Cookies We Use

You can also opt out of personalized advertising through the Digital Advertising Alliance.

đŸ’ŗ Fee Schedule

Effective Date: July 1, 2025

RaiseIt's fee structure is designed to be transparent and competitive. All fees are clearly communicated before any transaction is finalized.

4.1 Platform Fees

Example: If a Campaign raises $10,000 from US-based backers, the Creator receives approximately $8,740 after fees (5% platform fee + 2.9% payment processing + transaction fees).

4.2 Pledge Models

  • All-or-Nothing: If a Campaign does not reach its funding goal by the deadline, no funds are collected and all pledges are canceled. No fees apply.
  • Flexible Funding: The Creator keeps all Funds regardless of whether the goal is met. Fees apply on all collected Funds.

4.3 Fund Disbursement

Funds are disbursed to Creators within 5–7 business days after the Campaign ends (and meets its goal, if applicable). For Campaigns using Flexible Funding, disbursement occurs in 14-day installments or as a lump sum based on Creator preference.

4.4 Currency and Exchange

Campaigns can be listed in multiple currencies. Exchange rates are set at the time of each transaction and may fluctuate. RaiseIt does not add markup to exchange rates.

â†Šī¸ Refund Policy

Effective Date: July 1, 2025

5.1 General Policy

RaiseIt provides a standardized refund framework while giving Creators flexibility to set their own refund policies within their Campaign pages.

5.2 Automatic Refund Scenarios

  • Unfunded Campaigns (All-or-Nothing): Full automatic refund if the funding goal is not met
  • Campaign Cancellation by RaiseIt: Full refund if RaiseIt removes a Campaign for policy violations
  • Campaign Cancellation by Creator: Full refund if the Creator voluntarily cancels the Campaign
  • Chargebacks: Processed according to payment processor rules; Creators may be liable for chargeback fees

5.3 Post-Funding Refunds

After a Campaign is successfully funded, refund requests are handled by the individual Creator. RaiseIt recommends that Creators include a clear refund policy in their Campaign description. We encourage Creators to offer refunds in cases of:

  • Significant delays beyond the promised timeline
  • Major changes to the project scope or rewards
  • Project cancellation after funding

Note: RaiseIt acts as a neutral intermediary in refund disputes. If a Creator denies a refund request, Backers may pursue chargebacks through their payment provider or contact RaiseIt support for mediation.

5.4 Refund Processing Time

Refunds are typically processed within 5–10 business days, depending on the payment method and bank. Credit card refunds may take an additional 2–3 billing cycles to appear on statements.

âš–ī¸ DMCA & Copyright Policy

Effective Date: July 1, 2025

RaiseIt respects the intellectual property rights of others and expects its users to do the same. We respond to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA) of 1998.

6.1 Reporting Copyright Infringement

If you believe content on RaiseIt infringes your copyright, please send a written notification to our Copyright Agent at:

  1. A physical or electronic signature of the copyright owner or authorized agent
  2. Identification of the copyrighted work claimed to be infringed
  3. Identification of the infringing material and its location on our Platform
  4. Your contact information (address, telephone, email)
  5. A statement of good faith belief that the use is not authorized
  6. A statement, made under penalty of perjury, that the information is accurate

6.2 Counter-Notice

If you believe your content was removed in error, you may submit a counter-notice containing:

  • Your contact information
  • Identification of the removed content and its location
  • A statement under penalty of perjury that you have a good faith belief the material was removed in error
  • Your consent to the jurisdiction of federal court

6.3 Repeat Infringers

RaiseIt reserves the right to terminate accounts of users who are determined to be repeat infringers of copyright or other intellectual property rights.

🤝 Dispute Resolution

Effective Date: July 1, 2025

7.1 Informal Resolution

Before pursuing formal dispute resolution, we encourage you to contact us at disputes@raiseit.com to attempt an amicable resolution. We will respond within 15 business days.

7.2 Mandatory Arbitration

Any dispute, claim, or controversy arising from or relating to these Terms or the Service that cannot be resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration shall be conducted in Wilmington, Delaware.

Class Action Waiver: You agree that any arbitration or proceeding shall be conducted only on an individual basis and not as a class action or representative proceeding. This waiver applies to all disputes regardless of whether they arose before the effective date of these Terms.

7.3 Exception to Arbitration

Either party may bring an individual action in small claims court. Either party may bring a suit in court to seek injunctive or other equitable relief for the alleged unlawful use or misuse of intellectual property or trade secrets.

7.4 Attorney's Fees

If any legal action or arbitration is brought to enforce or interpret these Terms, the prevailing party shall be entitled to recover reasonable attorney's fees and costs.
