Governing Law & Jurisdiction
This document outlines the legal framework, applicable jurisdiction, dispute resolution mechanisms, and regulatory compliance standards governing In Therapy's platform, services, and client relationships.

All relationships, transactions, services, and disputes arising from or related to the use of In Therapy's platform, therapeutic services, client agreements, and this governing law document shall be governed by and construed in accordance with the laws of the State of [Your State], United States, without giving effect to any principles of conflicts of law that would require the application of the laws of another jurisdiction.
Mental health services provided through our platform are subject to state-specific licensing requirements, scope-of-practice regulations, and telehealth statutes. By engaging with In Therapy, clients acknowledge that their therapeutic relationship is established under the professional licensing laws of the provider's state of licensure, where applicable.
2. Jurisdiction & Venue
Any legal action, proceeding, or claim arising out of or relating to this governing law document, our terms of service, or the provision of therapeutic services shall be brought exclusively in the federal or state courts located in [County], [State]. Both parties hereby consent to the personal jurisdiction and venue in such courts and waive any objections to venue or forum non conveniens.
For telehealth services crossing state lines, jurisdiction shall be determined based on the therapist's primary state of licensure and practice, in compliance with the Interstate Medical Licensure Compact and applicable telehealth regulations.
3. Dispute Resolution
Before initiating any litigation, the parties agree to attempt to resolve disputes through good-faith negotiation. If unresolved within thirty (30) days, disputes shall be submitted to confidential mediation administered by a neutral third-party mediator licensed in [State].
Should mediation fail, any remaining disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. Arbitration shall take place in [City], [State], and the decision of the arbitrator shall be final and enforceable in any court of competent jurisdiction.
Note: This arbitration requirement does not apply to claims involving urgent mental health crises, mandatory reporting obligations, or violations of patient rights that may require immediate judicial intervention.
4. Healthcare & Privacy Compliance
In Therapy operates in strict compliance with applicable federal and state healthcare regulations, including but not limited to:
- Health Insurance Portability and Accountability Act (HIPAA) Privacy and Security Rules
- 21st Century Cures Act and Information Blocking regulations
- State mental health confidentiality and mandatory reporting statutes
- Telehealth practice standards and cross-state licensure requirements
Client protected health information (PHI) is handled exclusively through HIPAA-compliant platforms, encrypted communications, and secure electronic health record (EHR) systems. Therapists adhere to ethical guidelines established by their respective licensing boards and professional associations (e.g., APA, NASW, AAMFT).
5. Limitation of Liability
To the fullest extent permitted by applicable law, In Therapy and its licensed providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, emotional distress, or interruption of therapy sessions, arising from the use of our platform or services.
Clients acknowledge that therapy outcomes vary and that In Therapy does not guarantee specific clinical results. In the event of a technology failure, platform outage, or scheduling error, our sole obligation shall be to reschedule services or provide a prorated credit, subject to availability and clinical appropriateness.
6. Severability & Amendments
If any provision of this governing law document is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable while preserving its original intent.
In Therapy reserves the right to update, modify, or replace this document at any time. Material changes will be communicated via email and platform notification at least fourteen (14) days prior to the effective date. Continued use of our platform or services following such notice constitutes acceptance of the updated terms.
