1. Acceptance of Terms
By accessing, registering for, or using any services, facilities, or digital platforms provided by IronForge Fitness ("Company," "we," "our," or "us"), you ("Member," "user," or "you") acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, you must discontinue use of our facilities and services immediately.
These terms constitute a legally binding agreement between you and IronForge Fitness. We reserve the right to modify these terms at any time. Continued use of our services following posted modifications constitutes acceptance of the revised terms.
2. Membership & Account Terms
To access IronForge Fitness facilities and services, you must be at least 18 years of age or provide verifiable parental/guardian consent if aged 14–17. Minors under 14 are not permitted in the facility without direct staff supervision.
- Accuracy of Information: You are responsible for maintaining the confidentiality of your account credentials and ensuring that all registration information is accurate, current, and complete.
- Account Responsibility: You agree to notify us immediately of any unauthorized use of your account or membership key fob/access card.
- Transferability: Memberships are non-transferable and intended solely for the registered member, unless explicitly stated as a shared or family plan.
- Guest Policy: Guests are permitted only under specific membership tiers and must sign a temporary liability waiver at each visit. Members remain fully responsible for their guests' conduct and compliance with facility rules.
3. Facility Usage & Code of Conduct
IronForge Fitness maintains a professional, safe, and inclusive environment. Members must adhere to the following conduct standards:
- Respectful Behavior: Harassment, discrimination, verbal abuse, or intimidating behavior toward staff, members, or guests will result in immediate suspension or termination.
- Equipment Care: Members must use all equipment according to posted guidelines. Re-rack weights, wipe down surfaces, and report malfunctions to staff.
- Dress Code: Proper athletic footwear and appropriate workout attire are required. Denim, sandals, or clothing that damages equipment is prohibited.
- Baggage & Lockers: Use provided lockers for temporary storage. IronForge Fitness is not responsible for lost, stolen, or damaged personal belongings. Valuables should not be left unattended.
- Photography & Recording: Commercial photography, streaming, or recording requires prior written authorization. Casual personal photography is permitted in non-restricted areas without disturbing others.
4. Health, Safety & Liability Waiver
⚠️ IMPORTANT: Participation in physical fitness activities carries inherent risks. By using IronForge Fitness, you voluntarily assume all risks associated with exercise, equipment use, and participation in group or personal training programs.
Members represent that they are in good health and have no medical conditions that would be exacerbated by strenuous physical activity. We strongly recommend consulting a physician before beginning any new fitness regimen.
IronForge Fitness, its employees, contractors, and affiliates shall not be held liable for any personal injury, property damage, illness, or loss arising from your use of the facilities, equipment, or services, except where prohibited by applicable law.
5. Payment, Billing & Cancellation
All membership fees, personal training packages, and ancillary services are subject to the pricing schedule in effect at the time of purchase. Additional taxes and government-mandated fees may apply.
- Billing Cycle: Memberships are billed on a recurring monthly or annual basis on the original enrollment date.
- Payment Method: Valid credit/debit card or authorized auto-debit account is required. Failure to update expired payment information may result in suspension.
- Cancellation Policy: Monthly members may cancel at any time by providing written notice before the next billing cycle. Annual memberships are non-refundable but may be paused for medical or military reasons with proper documentation.
- Freeze/Deferred Status: Members may request up to 3 months of deferred status per year. Standard dues will resume automatically upon return.
6. Prohibited Activities
The following activities are strictly prohibited on IronForge Fitness premises:
- Use of illegal substances, alcohol, or unauthorized supplements
- Smoking or vaping (including designated outdoor areas unless explicitly permitted)
- Unauthorized distribution of promotional materials or solicitation
- Engaging in political, religious, or commercial fundraising without management approval
- Bringing outside pets (service animals are permitted per ADA/local law)
- Tampering with security systems, equipment, or facility infrastructure
Violation of any prohibited activity may result in immediate termination of membership without refund.
7. Intellectual Property
All content, branding, trademarks, training methodologies, digital platforms, mobile applications, and marketing materials associated with IronForge Fitness are the exclusive property of the Company and protected by copyright, trademark, and intellectual property laws.
Members may not reproduce, distribute, modify, or create derivative works from any IronForge Fitness materials without prior written consent. Limited personal use of workout plans or digital content is permitted solely for the member's own fitness purposes.
8. Limitation of Liability
To the fullest extent permitted by law, IronForge Fitness and its directors, officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or other intangible losses resulting from your access to or use of our services.
Our total aggregate liability shall not exceed the amount of membership fees paid by you in the 12 months preceding the claim. This limitation applies regardless of the legal theory upon which the claim is based.
9. Privacy & Data Protection
Your personal information is collected, stored, and processed in accordance with our Privacy Policy. By agreeing to these Terms, you consent to the collection and use of your data for membership management, service improvement, marketing communications, and legal compliance.
We employ industry-standard encryption, access controls, and secure servers to protect your data. However, no internet transmission or digital storage system is completely secure. You acknowledge the inherent risks of sharing information digitally.
10. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your membership shall first be subject to good-faith negotiation. If unresolved, parties agree to submit to binding arbitration administered by the American Arbitration Association (AAA) in New York County, NY. Class action lawsuits and jury trials are expressly waived, to the extent permitted by law.
