4. Cap on Liability
Notwithstanding anything to the contrary in these Terms, VitaWell's aggregate liability arising out of or related to these Terms or the use of our services shall not exceed the greater of: (a) one hundred U.S. dollars (USD $100.00), or (b) the total amount paid by you to VitaWell for the specific service giving rise to the claim during the twelve (12) months immediately preceding the date of the claim.
This limitation applies to all claims, including those for breach of contract, tort (including negligence), strict liability, or any other theory, regardless of whether VitaWell has been advised of the possibility of such damages.

You agree to indemnify, defend, and hold harmless VitaWell, its officers, directors, employees, agents, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or related to:
- Your use of or inability to use our services;
- Your violation of these Terms or any third-party rights;
- Your reliance on any content, advice, or recommendations provided through our platform;
- Any claims arising from your health outcomes or experiences while using our services.
8. Force Majeure
VitaWell shall not be liable for any failure or delay in performance of its obligations under these Terms if such failure or delay is caused by events beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, civil unrest, government actions, pandemics, epidemics, internet or telecommunications failures, power outages, or labor disputes.
9. Severability
If any provision of this Limitation of Liability is found to be unenforceable, invalid, or prohibited by law, such provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. Where permitted by law, the unenforceable provision shall be replaced with a provision that is enforceable and comes closest to expressing the intention of the unenforceable provision.
