Automated scraping, bulk downloading, or high-frequency API requests require prior written authorization from our administration team to preserve server stability and archival integrity.

4. Intellectual Property & Archived Content

The 1990 Web Archive does not claim ownership of the underlying intellectual property rights of the Archived Content. All copyrights, trademarks, and proprietary rights remain with their original creators or rights holders. The Archive's proprietary system, database structure, metadata schema, rendering engine, and platform interface are the exclusive property of 1990 Web Archive and may not be reproduced, reverse-engineered, or redistributed without express written consent.

5. User Conduct & Prohibited Activities

You agree to use the Service responsibly and in compliance with all applicable laws. Prohibited activities include, but are not limited to:

• Uploading, sharing, or distributing malware, exploits, or malicious scripts through platform submission forms
• Misrepresenting archival data or engaging in coordinated campaigns to manipulate historical records
• Using the platform to host, promote, or facilitate illegal activities, hate speech, or non-consensual personal data exposure

Violations of these conduct standards may result in immediate account suspension, IP-level access revocation, or legal action where applicable.

6. Disclaimers & Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. While we employ rigorous verification and cryptographic timestamping to preserve historical accuracy, we do not warrant that all Archived Content is complete, unaltered, or fully representative of its original live state. Network fluctuations, deprecated protocols, or missing server-side dependencies may affect rendering fidelity.

To the fullest extent permitted by law, 1990 Web Archive, its directors, employees, and partners shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of, or inability to use, the Service, including but not limited to data loss, research delays, or third-party content disputes.

8. Termination

We reserve the right to suspend or terminate access to the Service at our sole discretion, without prior notice, for users who violate these Terms, engage in fraudulent activity, or pose a security risk to the Archive's infrastructure. Upon termination, all rights granted to you under these terms will immediately cease.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the federal courts located in Washington, D.C.
