1. Acceptance of Terms

By registering for an account, browsing, or using any features of the BookEase platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and BookEase, Inc.

If you are using the Service on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms. You must be at least 18 years of age or the age of majority in your jurisdiction to use our Service.

2. Description of Services

BookEase provides a digital platform that connects users with service providers, enabling the scheduling, booking, and management of appointments, reservations, and events. The Service may include:

• Search, discovery, and booking of services and professionals
• Calendar management and scheduling tools
• Payment processing and transaction facilitation (where applicable)
• Automated reminders, notifications, and customer communication tools
• Analytics, reporting, and business management features

3. User Accounts & Registration

3.1 Account Creation

To access certain features, you must create an account by providing accurate, current, and complete information. You are responsible for safeguarding your login credentials and for all activities that occur under your account.

3.2 Account Security

You agree to notify us immediately at support@bookease.com of any unauthorized use of your account or any other breach of security. BookEase will not be liable for any loss or damage arising from your failure to comply with this obligation.

3.3 Age & Eligibility

The Service is not intended for individuals under 18. By using the Service, you represent that you are at least 18 years old or have parental/guardian consent.

4. Bookings & Transactions

4.1 Booking Process

When you book a service through BookEase, you are entering into an agreement with the service provider, not with BookEase. We facilitate the connection and transaction but do not control or guarantee service delivery.

4.2 Payments

All payments processed through BookEase are subject to our Payment Processing Policy. Prices are displayed in your local currency and are subject to change. Taxes, fees, or service charges may apply at checkout.

4.3 Cancellations & Refunds

Cancellation and refund policies are set by individual service providers and will be clearly displayed before confirmation. BookEase reserves the right to issue platform fee refunds in cases of technical failure or policy violation.

5. User Conduct & Prohibited Activities

You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Service. Prohibited activities include, but are not limited to:

• Submitting false, misleading, or fraudulent information
• Interfering with the security or functionality of the platform
• Using automated tools, scrapers, or bots to access or extract data
• Harassing, threatening, or discriminating against other users or providers
• Attempting to book services for illegal, unethical, or unauthorized purposes

We reserve the right to suspend or terminate access for any violation of these Terms or conduct that we deem harmful to our community.

6. Intellectual Property

All content, features, and functionality of the BookEase Service, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software, and the design, selection, and arrangement thereof, are owned by BookEase, its licensors, or other providers and are protected by intellectual property laws.

Grants of limited licenses are provided for your personal, non-commercial use. You may not modify, reproduce, distribute, or create derivative works without express written consent.

7. Disclaimers & Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, or accuracy.

To the fullest extent permitted by law, BookEase shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from your use or inability to use the Service, even if advised of the possibility of such damages.

Our total liability to you for any claim arising out of or related to these Terms or the Service shall not exceed the amount you paid us, if any, during the twelve (12) months preceding the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless BookEase, its affiliates, officers, directors, employees, agents, and service providers from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

• Your access to or use of the Service
• Your violation of these Terms
• Your infringement of any third-party right, including intellectual property or publicity rights
• Any dispute between you and a service provider or other user

9. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules, with judgment on the award enforceable in any court of competent jurisdiction.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
