1 Acknowledgment of Inherent Risks
Physical fitness activities, including but not limited to weight training, cardiovascular exercise, group fitness classes, boxing/MMA, yoga, and functional training, carry inherent risks of physical injury, illness, or even death. These risks may result from your own actions, the actions of others, equipment failure, facility conditions, or unforeseen circumstances.
By accessing our facilities, attending classes, or utilizing our services, you explicitly acknowledge and accept these risks voluntarily.
⚠️ Important Notice
IronForge Fitness recommends consulting a licensed physician before beginning any exercise program, especially if you have pre-existing conditions, have been sedentary, or are over 45 years of age.
2 Liability Waiver & Release
As a condition of membership or facility access, you agree to the following:
- You release, waive, discharge, and covenant not to sue IronForge Fitness, its owners, operators, employees, contractors, and agents from any and all liability, claims, demands, or causes of action arising from your participation in our programs.
- This waiver covers injuries resulting from negligence, equipment malfunction, facility hazards, or instruction provided by our staff.
- You assume full responsibility for your personal safety, equipment handling, and adherence to posted facility rules.
- Any photographic, video, or audio recordings taken on premises may be used by IronForge Fitness for promotional, marketing, or training purposes without compensation.
3 Health Screening & Medical Disclosure
Members are legally required to complete a PAR-Q+ (Physical Activity Readiness Questionnaire) and disclose any relevant medical conditions, injuries, or medications to our staff prior to participation. Failure to disclose material health information that affects your ability to safely exercise may void your coverage under our facility insurance and liability protections.
IronForge Fitness reserves the right to deny access or suspend membership if we determine a member's condition poses an immediate threat to their safety or the safety of others.
4 Facility Safety & Equipment Protocols
To minimize risk, all members must adhere to the following safety guidelines:
- Inspect equipment before use. Report damaged or malfunctioning items to staff immediately.
- Use proper form and technique. Ego-lifting or improper mechanics significantly increase injury risk.
- Re-rack weights and return equipment to designated areas after use.
- Wear appropriate athletic footwear and attire. Steel-toed boots, sandals, or open-toed shoes are prohibited on the weight floor.
- Spotters are mandatory for maximal or near-maximal lifts on benches, racks, and platforms.
5 Emergency Procedures & Medical Authorization
In the event of a medical emergency, IronForge Fitness will:
- Immediately contact emergency medical services (911).
- Administer first aid/CPR/AED treatment if certified staff are available.
- Contact your listed emergency contact person.
By registering, you authorize IronForge Fitness personnel to arrange and provide emergency medical treatment, including transportation to a hospital, at your own expense. You assume full financial responsibility for all medical costs incurred during or as a result of your visit.
6 Insurance & Coverage Information
IronForge Fitness maintains comprehensive general liability insurance and property damage coverage. However, this insurance does not cover:
- Personal property loss or theft (lockers and valuables are used at your own risk).
- Injuries resulting from gross negligence, intentional misconduct, or violation of facility rules.
- Pre-existing conditions exacerbated by exercise without proper medical clearance.
We strongly recommend members maintain personal accident, health, and disability insurance to supplement our coverage.
7 Governing Law & Amendments
This Liability & Risk Policy shall be governed by and construed in accordance with the laws of the State of New York. Any disputes arising from this agreement shall be resolved through binding arbitration or in courts of competent jurisdiction within the county of our primary facility.
IronForge Fitness reserves the right to modify this policy at any time. Continued use of our facilities or services constitutes acceptance of any updates, which will be posted on our member portal and physical locations.
