1. Acceptance of Terms

By registering for an account, purchasing a membership, or using any IronForge Fitness services (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service and our Privacy Policy. If you do not agree, you must not use our Services.

You represent that you are at least 18 years of age, or if between 13-17, that you have obtained parental or guardian consent. Minors must be accompanied by a guardian at all times within our facilities.

2. Membership & Access

Membership accounts are personal and non-transferable. You are responsible for maintaining the confidentiality of your login credentials and for all activities occurring under your account. Access to facilities, classes, and digital services is granted solely based on your active membership tier and may be revoked for non-payment or violation of these terms.

IronForge Fitness reserves the right to verify membership status via ID scan, key fob, or mobile app at any time. Unauthorized use of another member's credentials will result in immediate termination of both accounts.

3. Code of Conduct

To maintain a safe, respectful, and high-performance environment, all members must adhere to the following standards:

• Respect all staff, trainers, and fellow members. Harassment, discrimination, or abusive behavior will not be tolerated.
• Use all equipment according to posted guidelines and manufacturer instructions.
• Re-rack weights, wipe down machines, and return equipment to designated areas after use.
• Appropriate athletic attire and footwear are required at all times. Flip-flops, jeans, and bare feet are prohibited in training zones.
• Recording devices, cameras, and smartphones may not be used to capture images or video of other members without explicit written consent.

4. Liability & Assumption of Risk

PHYSICAL FITNESS INVOLVES INHERENT RISKS. By participating in any IronForge Fitness activities, including but not limited to strength training, group classes, personal training, boxing, and cardio sessions, you voluntarily assume all known and unknown risks of injury, disability, or damage.

You agree to hold harmless, release, and indemnify IronForge Fitness, its owners, employees, contractors, and affiliates from any claims, liabilities, damages, or expenses arising from your participation, except where expressly prohibited by law.

5. Health & Safety Requirements

You are responsible for consulting a qualified healthcare professional before beginning any exercise or nutrition program. IronForge Fitness services are not a substitute for professional medical advice, diagnosis, or treatment.

Members must immediately notify staff if they feel unwell, experience pain, or require emergency assistance. Our facilities are equipped with basic first aid, but we do not provide medical services. In emergencies, local EMS will be contacted.

6. Privacy & Data Usage

Your privacy is important to us. The collection, use, and protection of your personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference. We may use your data to manage memberships, improve services, communicate schedules, and comply with legal obligations.

Biometric data (if used for access control) and health metrics shared via our app are processed securely and in compliance with applicable data protection regulations.

7. Intellectual Property

All content, branding, training methodologies, workout programs, digital platforms, logos, and materials provided by IronForge Fitness are the exclusive intellectual property of IronForge Fitness or its licensors. You may not reproduce, distribute, modify, or commercially exploit any content without prior written authorization.

8. Termination & Cancellation

You may cancel your membership at any time in accordance with your plan's cancellation policy. Early termination fees may apply based on contract terms. IronForge Fitness reserves the right to suspend or terminate accounts for breach of these terms, repeated code of conduct violations, or non-payment.

Upon termination, all access privileges will be revoked immediately, and outstanding balances must be settled in full.

9. Disclaimers & Limitation of Liability

Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. IronForge Fitness does not guarantee specific fitness results, as outcomes depend on individual effort, consistency, and health conditions.

To the maximum extent permitted by law, IronForge Fitness shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or personal injury arising from service interruptions or misuse.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes arising from these Terms shall first be resolved through good-faith negotiation. If unresolved, mandatory binding arbitration shall apply in accordance with the American Arbitration Association rules, unless otherwise required by law.

11. Modifications to Terms

IronForge Fitness reserves the right to update, modify, or replace these Terms at any time. Changes will be effective immediately upon posting. Your continued use of our Services after modifications constitutes acceptance of the updated terms. We encourage periodic review of this page.
